LOUISVILLE, Ky. (WDRB) -- A grand jury did not indict a woman charged in the death of a 2-year-old Louisville boy in a hot van.

LaVontae Xavier Swain, 2, died back in April in a day care van outside Gutermuth Elementary School.

Swain's great aunt, 70-year-old Jacqueline Thomas was arrested several weeks later. A Jefferson County grand jury did not indict Thomas this week, according to Commonwealth's Attorney spokesperson Jeff Cooke. The decision means there are no longer criminal charges pending against her.

Swain was left in the van for three or four hours.
