Harrison County Democratic Party sues clerk over voting machine security

CORYDON, Ind. (WDRB) -- Indiana is poised to set a new early voting record. More than 600,000 absentee ballots have been cast in person and through other methods, with the election still days away.

It's the people who will show up Tuesday that Democrat and Harrison County Election Board member Gordon Ingle is concerned about.

"We have an obligation to the public to make sure the election is fair," Ingle said.

He and the rest of the Harrison County Democratic Party have filed suit against County Clerk Sally Whitis. The Democrats say it all centers around the Harrison Government Center and a room inside that stores voting machines.

"It was left unlocked completely. All you need is seven minutes and a screw driver and a computer chip to rig a machine," Ingle said.

Also at issue is a missing padlock.

"Bi-partisan security ... that's what the law requires, and she didn't do it," Ingle added.

Usually the Republicans and Democrats each have their own lock to gain access to the machines. Ingle says the Democrats are missing theirs, and no one bothered to say anything about it.

"At the very least, she should've told me that there was Democratic key on there in September," Ingle said. 

Whitis says the suit and the allegations are bogus. 

"I just think it's a last-minute election ploy," Whitis said.

She says she also wants people to know how seriously she takes the security of the voting machines.

"It was under lock and key since the IT person with the election programmed it. The machines themselves are in boxes that are double-locked and sealed," Whitis said.

Late Friday afternoon, Ingle told WDRB that a Harrison County Judge sided with Whitis. 

Ingle says he believes the judge misinterpreted the law.
