LOUISVILLE, Ky. (WDRB) -- Three men have been charged with a murder that took place in St. Matthews last year.

According to an arrest report, DeWayne Dunn was arrested Wednesday, just after 11 a.m. Gary Burns and Quantez Willis, who were already in jail, have also been charged, according to a St. Matthews Police spokesperson. Each of the men is charged with complicity to murder and complicity to tampering with physical evidence.

The murder took place at the Mallgate Apartments at 501 Quails Run Court just before 9 p.m. on Nov. 19. That's where police say they found the victim -- 26-year-old Matthew Upton -- with a gunshot wound to the chest.

Upton was taken to University Hospital where he was pronounced dead. 

According to the arrest report, Dunn, Burns and Willis shot Upton during a drug transaction. Police say witnesses and cell phone records place Dunn at the scene at the time of the murder.

The three men allegedly threw the gun from the getaway vehicle in order to dispose of it.

Daniel Torrealba lived next door to Upton when he was shot in November.

"I know him, he is a very good person," Torrealba said. "We exchanged food - I'm from Venezuela, so I gave him food from my country. He gave me food for my birthday. We played PlayStation together. He was a really good person."

Police said wasn't the first time they have investigated a murder at the apartment. One person was killed in a violent confrontation there in 2015.
