Man who fled Louisville is arrested in Indianapolis

A Louisville man who eluded police for weeks has been arrested in Indianapolis.  Davon Tooley was scheduled to go on trial for murder later this month.  But this latest arrest might delay his trial.

Tonight, Davon Tooley sits in an Indianapolis jail and it's unclear when he will return to Metro Corrections. He was scheduled to go on trial for murder on May 19th. But that trial will likely be delayed again as he will now face other charges.

22-year old Davon Tooley had eluded authorities since April 20th.  On Thursday, U.S. Marshals found him -- 110 miles north of Louisville in Indianapolis.

"All we know is we got a call saying he was captured and it was like whew! You know. A big relief," said Gina Walls.

It was the news Gina Walls had been waiting to hear. "It was almost elation for my family really."

Walls and her family were anxious for Tooley's capture.

He is accused of gunning down Walls' nephew, Jerrell Vitt outside this apartment complex in January of 2006.  "There will always be a piece of our family missing and at this point all we can do is hope for the best at trial," said Walls.

The trial was scheduled to start in February but was delayed when witnesses didn't surface.  A judge and prosecutors then agreed to allow Tooley to be placed on home incarceration in late March.  That's where he remained until April 20th, when Metro Corrections officials say he cut off the ankle bracelet that tracked his whereabouts.  He had been on the lam until now.

"The whole thing has been awful," said Walls.

Walls knows another trial delay is possible, but is thankful no one else was injured.

Tooley had warned others he wouldn't be taken in quietly. U.S. Marshals considered him to be armed and dangerous. Tooley was arrested without incident.

"We're just really looking forward to getting it all over with," said Walls.

Walls says jury selection was supposed to begin on May 19th.  Instead, that day will be slated as another hearing.
