Prosecutors will seek the death penalty against a man charged with murdering a small-town police chief.

Jamie Barnett is accused of shooting and killing Clay City Police Chief Randy Lacy from the back of his squad car during an arrest last year.

A county circuit judge Monday ruled that Barnett could face the death penalty after a hearing to determine if he was mentally impaired.

Three of Barnett's sisters testified their brother suffered from mental disability since he was a kid.  But an expert says tests showed Barnett likely exaggerated his mental impairments.

Jury selection in the trial starts Tuesday.
