Comair wants to sue Blue Grass Airport for deadly crash

Comair wants to put part of the blame of a deadly plane crash on Lexington's Blue Grass Airport.

The airline asked the Kentucky Supreme Court Wednesday to let it sue the airport for the August 2006 crash that killed 49 people.

A federal judge previously ruled that the airport has sovereign immunity because it performs an essential governmental function.

Comair argues the airport is partly to blame for the accident, and should have to help pay legal bills from the crash.

The plane crashed after departing from the wrong runway, which was too short.
