Defense attorney Frank Mascagni III arrested over tax issue

LOUISVILLE, Ky., (WDRB) -- High-profile Louisville defense attorney Frank Mascagni III was briefly arrested at U.S. District Court on Tuesday after a warrant was issued last month.

Mascagni failed to comply with orders from the Department of Justice to turn over tax information, according to an arrest warrant and motion for contempt signed by U.S. District Judge John Heyburn.

Mascagni, who has represented some of Louisville's most notorious defendants, said he was detained for about two hours until going before Heyburn Tuesday afternoon.

Heyburn did not find Mascagni in contempt and released him from custody but ordered him to comply with requests for tax documents by Jan. 7.

“I'm embarrassed,” Mascagni said in an interview Wednesday. “I've retained counsel and I'm going to comply with the court orders for the timelines imposed.”

The Internal Revenue Service is investigating Mascagni's federal income tax liabilities from 2005 through 2012 and has issued summonses directing Mascagni to testify and provide records several times, most recently last month, according to court records. Mascagni has failed to appear or turn over records in the civil case.

“Based on my busy schedule, I didn't prioritize this the way I should have,” Mascagni told WDRB News.

Michael Mazzoli and Scott C. Cox, the attorneys representing Mascagni, did not immediately return messages seeking comment.

A call to a Department of Justice spokesperson was not immediately returned.
