Colorado brewer sues Jeffersonville’s Red Yeti brewpub in trademark dispute

LOUISVILLE, Ky. (WDRB) – Since opening in 2013, The Red Yeti brewpub and restaurant in Jeffersonville, Ind., has used a sunglasses-clad, arm-swinging creature as its logo.

But to Denver’s Great Divide Brewing Co., the beast that adorns the Spring Street business is an abomination that needs to go.

Great Divide filed a federal lawsuit against Red Yeti on Friday, accusing the Southern Indiana company of trademark infringement, deceptive trade practices and unfairly using the image. It seeks an injunction banning Red Yeti from displaying the “confusingly similar” design, a jury trial and unspecified damages.

“Great Divide has continually used the Yeti Design Mark since at least 2008 to identify its beers, and to distinguish them from the products of other breweries,” the Colorado brewer says in its complaint filed in U.S. District Court in New Albany.

At issue is a trademark that shows the outline of a yeti – the mythical, apelike creature said to live in the Himalayas -- that Great Divide says it registered in 2012. Another design has been used since 2004, the lawsuit claims.

The yeti logo appears on Great Divide beer labels, including its “Yeti Imperial Stout” and “Chocolate Yeti Bomber,” the company’s tap handles and other merchandise. People now associate these designs with Great Divide, the brewer says in court papers.

Red Yeti continues to use its designs despite being given a “cease and desist” demand from Great Divide, according to the lawsuit. An owner of the Jeffersonville restaurant did not immediately respond to a phone message and email seeking comment.

Great Divide is asking a judge to order Red Yeti to destroy all “signs, menus, advertisements, packages” and other materials that infringe on the Colorado brewer’s trademarks.
