The filing comes about two months after attorneys for Lawson asked a judge to either grant him a new trial or throw out the May 30 guilty verdict, arguing he was denied a fair trial.
The defense argues Lawson has not yet been shown all of the evidence against him yet, and that just recently more evidence was turned over by the federal government that was only recently discovered by prosecutors.
In a hearing focused on whether to separate the trials for Brooks Houck, Joseph Lawson and Steve Lawson, prosecutor Shane Young was asked by the judge whether the searches in early September would produce more evidence in the case.
"No, sir, not much," Young told Judge Chares Simms III.
Steve Lawson is scheduled to appear in Nelson Circuit Court Thursday morning.
Steve Lawson said in a jail phone conversation that he and his son, Joseph, picked up Crystal Rogers vehicle in the Woodlawn subdivision when she disappeared in 2015, the same place investigators recently searched for her body, according to court records.
The Kentucky Supreme Court denied a request to review whether Brooks Houck's bond should remain at $10 million cash while he awaits trial for the murder of his former girlfriend, Crystal Rogers.
Attorney Brian Butler said Houck is a "pariah" locally and also didn't want the trial to be held in any county in central Kentucky, including Fayette or Jefferson counties. He suggested Boyd County or Daviess County, since they are outside the Louisville and Lexington media markets and are "demographically" similar to Nelson.
Steve Lawson, 1 of 3 men charged in Crystal Rogers case, says he was promised immunity for testimony
Attorney Theodore Lavit will argue in a court hearing March 21 that Lawson was interviewed by the Nelson County Commonwealth’s Attorney’s office and the FBI repeatedly in the years since Rogers disappeared in 2015 and “from the very beginning,” police and prosecutors made it clear any statements made would not be used against him.
The prosecution will ask that the three men stand trial together. Defense attorneys will make a motion to move the case out of Nelson County.
