LOUISVILLE, Ky. (WDRB) -- A judge has denied a request for home incarceration for a man accused of driving drunk and causing a fatal crash over the weekend.
The crash happened around 12:30 a.m. Saturday in the westbound lanes of I-264, near Taylor Boulevard and Dixie Highway.Â
Police arrested 25-year-old Jacob Clayton after the crash. LMPD investigators say Clayton told officers he had a couple of shots of alcohol around 6 p.m. Friday, after he got off work. He said he then laid down until about 9:30 that night, before trying to drive to his girlfriend's house in New Albany.
Clayton told police a vehicle in front of him hit the brakes, as he was driving on I-264W, so he swerved into the emergency lane to avoid a collision. That's when he hit a stalled vehicle on the side of the road, killing 35-year-old LaDavid DeLorch, who was inside.Â
Police say when they arrived at the scene, Clayton had glassy eyes and smelled like alcohol.
An arrest report states that before being asked to do so, Clayton began a field sobriety test and tried to walk a straight line. Police say he could not keep his balance, and eventually took off his sandals.
Police say Clayton had a blood alcohol level of .13.
In court Monday, Clayton's attorney requested a lower bond and asked that his client be released on home incarceration. The judge denied that request after the prosecutor argued that Clayton is a danger to the community.
Clayton is charged with murder, DUI and driving without insurance. He's being held on a $50,000 full cash bond.Â
