LOUISVILLE, Ky. (WDRB) -- The judge in the case against Clark County Councilman and Clarksville Police officer John Miller has agreed to a change of venue.
Miller is a defendant in the high-profile case of former Clark County Sheriff Jamey Noel, who pleaded guilty to 27 felonies and sentenced to 12 years in prison last month.
His attorneys filed a motion in court on Oct. 11 to dismiss the charges and requested a change of venue. The defense argued Miller has already been convicted in the court of public opinion and can't get a fair trial in Clark County.
Miller is accused of accepting gifts, including meals and concert tickets, from Noel without disclosing a conflict of interest while voting on certain funding decisions on council.
Judge Larry Medlock granted the order for a change of venue from Clark County on Thursday, but did not dismiss the case against Miller.
The new location for his trial will be determined as early as next week. As of now, his trial date of Feb. 3 is still in place.
