“This court should dismiss the case against (the woman) and rule that citing an unhoused person simply because they needed to sit down during early labor is cruel and unusual punishment under the Eighth Amendment.”

The charges against Elayshia Boey and her mother, including felony assault of a police officer, were dismissed in October, according to court records. 

While on the way to the hospital and "while completely restrained," Mariah Reed gave birth, the suit claimed. Around two hours later the child died at the hospital.
