A federal lawsuit filed this week accuses former University of Kentucky football player Maxwell Hairston of sexually assaulting a female student in her dorm room during his freshman year on campus.
The case, filed last year, alleges misconduct by Jorgensen and names the university and athletics director Mitch Barnhart as additional defendants.
The ruling keeps some claims intact under Kentucky’s five-year statute of limitations for sexual offenses, allowing the case to proceed under state law.
The original complaint accuses UK, President Eli Capilouto, athletic director Mitch Barnhart, former swim coach Lars Jorgensen and former swim coach Gary Connelly of failing to address allegations of sexual abuse by Jorgensen, or failing to act on red flags in his hiring process.
UK agreed with the NCAA that it failed to monitor its swimming and diving program and that the underlying violations demonstrated a head coach responsibility violation.
WDRB could find no criminal complaints filed in Kentucky at the time of the alleged assaults.
