“This court should dismiss the case against (the woman) and rule that citing an unhoused person simply because they needed to sit down during early labor is cruel and unusual punishment under the Eighth Amendment.”

Marlo Brown was pulled over for failing to signal while changing lanes, but the Louisville police officer who made the stop called Brown a “fu**ing piece of sh**.”

The high court ruled on Oct. 28 that it is unconstitutional for jailers to take money from inmates. Only a sentencing judge is “able to order the reimbursement and billing of incarceration fees, not the county jail,” the ruling said.

"The judge's ruling defies public safety and common sense and we will proceed immediately with the appellate courts," County Attorney Mike O'Connell said in a statement Thursday.
