LOUISVILLE, Ky. (WDRB) -- The Louisville chiropractor accused of inappropriately touching a patient appeared before a judge Tuesday morning.

Brian Dell was arraigned this morning on sexual abuse charges and pleaded not guilty.

According to an arrest warrant, the sexual abuse took place on May 22.

Police say 44-year-old Brian Dell, a chiropractor, was giving a female patient an examination while she was asleep. According to the arrest warrant, the victim woke up during the examination to discover that Dell was fondling her. Police say the woman was "frozen in fear," but when Dell continued to fondle her, she jumped up, "pretending to wake up."

Dell quickly removed his hand and moved to the victim's neck area, police say.

According to the warrant, the victim asked Dell, "I guess that is not part of the regular massage, is it?"

Police say the victim told them that Dell "chuckled nervously" and told her that it wasn't.

Dell gave the victim some alignments, and then the woman left. She then went to her mother's house and told her what happened. She then went to Norton's Hospital, and the police were called. She was then told to go to University Hospital.

A report was taken, and a warrant was issued for Dell's arrest on Wednesday, June 24. He was taken into custody at his home on Friday afternoon.

Dell has been ordered to have no contact with the victim.

His attorney entered a not guilty plea on his behalf.
