LOUISVILLE, Ky. (WDRB) -- A Louisville man accused of shooting a gun inside a local CVS has a violent history, so some people believe he shouldn't be on the streets.
Damien Pulce is being held on a mental inquest warrant and will eventually be brought to Louisville Metro Corrections. One of his alleged victims believes he will be back on the streets soon.
The woman, who goes by Vee and didn't want to give her full name, spoke to WDRB News about her encounter with Pulce.
"I did my jog and came back to my place, and I was walking, cooling down for my run, and I saw him across the street," she said.
In April of 2022, the Louisville woman said she had just finished a run and came face to face with Pulce.
"I knew something wasn't right, so I kind of turned around and started to walk the other way," she said. "And I mean, it couldn't have been more (than) a couple seconds, I lost sight of him, and I heard him running up behind me."
In broad daylight, in front of her home on Douglass Boulevard, she said Pulce violently attacked her.
"He started to just kick and kick and kick me about my, you know, my torso, my ribs area," she said. "And I was hollering to stop, and hollering help. And then I started to kick back and fight back as best I could from the ground."
Pulce was eventually arrested and charged with attacking two women that day.
"I spoke with the detective, and, you know, asked him what was going to happen, and he said, 'Well, he'll go before the judge,'" she said
But despite the attacks and Pulce's lengthy criminal history, the case never saw the inside of a courtroom.
"And so looking back at his history, it appears that there have been multiple decisions by judges that he was not competent to stand trial," Louisville attorney Brian Butler said.
Butler is a former prosecutor.Â
"In order to stand trial, you have to be competent to stand trial," Butler said.
Butler said Pulce could continue to be released.
"And then once the person's not competent to stay at trial, you can't hold them forever," Butler said.
According to a police citation obtained by WDRB News, on Monday, Pulce was arrested after he pulled a gun and "fired one round into the floor" inside the CVS on Bardstown Road.
"I was really shocked," Vee said. "I mean, I, you know, had a kind of a visceral feeling in my gut that this guy's out there again."
Vee said she contacted Victim Information and Notification Everyday, also known as VINE, to find out why there was no warning.
"The woman I spoke to said that they have record of sending me a text last year in July that he was transferred to a different facility, and that's all," she said. "And I said, I never got that text."
