LOUISVILLE, Ky. (WDRB) --Â Herbert Lee, the man who took four young lives while running from police, will find out in just a few weeks if he will go back to jail.
The judge could find that he violated the terms of his release, forcing Lee to serve out the remainder of his probation, which is five months.
Lee appeared again in court this morning as the judge set another court date, this time to decide if Lee violated his release from prison.
This comes after police arrested him last Thursday night.
Officers say they found him behind the wheel of a stolen red Chevy Camaro.
The arrest came as a big surprise to the families of the four teens who were killed when Lee ran from police in a stolen car in Dec. 2008 and crashed into a tree.
Lee's family admitted to WDRB that there were warning signs that he was blowing his second chance.
The prosecutor says it's now up to a judge to decide if Lee will go back to jail.
"At this point, we'll present evidence as to whether or not the defendant violated the conditions of his release, and if the judge finds that he did, then he will have the option of revoking that," said prosecutor Kristi Gray.
Gray says if Lee goes back to jail he will serve that time in an adult facility, unlike before when he was in a juvenile center.
Lee is also charged with receiving stolen property and operating on a suspended or revoked license.
He is being held on a $10,000 bond and goes back to court July 27.
