Some call for Brady List in Bullitt County after officer lied under oath

LOUISVILLE, Ky. (WDRB) -- Nine months after a Hillview Police officerĀ was caught lying under oath about a sexual relationship with a teenager, some are questioning why he's now an officer at Pioneer Village, just a few miles away from his former post.

In a police video recorded in February, Officer Mike McNearĀ was caught lying under oath about a sexual relationship with a young woman that sheĀ said started when she was 18. In the video, McNear says:

"Alright, f*** it. I mean, we f***** around. We had f***** around. I mean, I don't want to lose my damn job."Ā 

Hillview Police Chief William MahoneyĀ said McNear violated numerous policies and procedures, but he has not been charged criminally.

"I think it's a concern when you have an officer terminated from our agency get hired at another agency," Hillview Police Lt. Charles McWhirter said.

Despite what's captured on video, the Bullitt County commonwealth's attorney says there will not be a case presented to the grand jury.

Nevertheless, some believe a Brady List, which is aĀ directory that attorneys canĀ use to see if officers who might testify in a case have potential credibility issues, should be utilized in Bullitt County. McNear first lied about the relationship when he testified in the case againstĀ Tammy Morris, who was arrested for disorderly conduct in September 2016. Morris was the girlfriend of the woman who McNear had the relationship with.

"The term Brady List, I believe started with LMPD," Mahoney said. "And they truly have a list of officers who have had findings of untruthfulness.

"There is no actual list in Bullitt County where someone can check a list to see if they've had that finding of untruthfulness. There probably should be one."

Bullitt County Attorney John Wooldridge said he received information that would affect McNear's testimony and added that it "would have been given to defense counsel on any case where this officer may testify."

Woolridge said, however, that his office has not been asked to prepare criminal charges against McNear.

"It makes it difficult, because there isn't a true list somewhere down at the courthouse that people can check," Mahoney said. "It's really just left up to the individual as well as to the agencies to report that information."

The Pioneer Village Police Chief DJ Reynolds and the city's mayor aren't commenting about hiring McNear. His personnel file there doesn't include any information about the Hillview firing. He did sign a Code of Ethics that says, "I will keep my private life unsullied as an example to all."
