Attorney General Russell Coleman filed a brief in response to Houck's appeal of his conviction to the Kentucky Supreme Court.
Court records show Lawson's attorney filed the documents on Wednesday, April 15.
The notice, filed in Nelson Circuit Court and dated Monday, Oct. 6, stated Houck's intention to take his appeal of the entire case to the Kentucky Supreme Court.
The hearing was originally scheduled for Thursday, Aug. 21 in Nelson County.
Kentucky State Police never ruled the 2016 shooting a hunting accident, and the Ballard family has long believed it was a targeted attack.
In one phone call, Brooks Houck tells his brother, Nick Houck "there's a good chance that I'm gonna die in here."
Tommy Ballard spent the last 18 months of his life searching for his daughter Crystal Rogers, and a mother of five who disappeared in July 2015 from Bardstown, Kentucky.
Tommy Ballard was the father of Crystal Rogers and became heavily invested in searching for her after she disappeared.
With every car and truck that passed by the crowd and honked, the crowd erupted in cheers.
The second murder trial of Brooks Houck and Joseph Lawson is now in its third week in Bowling Green 10 years after Crystal Rogers disappeared in Bardstown.
