As part of his upcoming October trial, prosecutors have asked to present evidence of two past disciplinary cases against Hankison, including driving the wrong way down Dixie Highway holding his gun out the window.
One person died and the other is in critical condition.
Hankison's attorney told jurors "You’re going to find that he was justified, his actions were reasonable given the chaotic situation he was in."
The lawsuit claims the two troopers who lived in an apartment above the family “recklessly” fired a bullet through their floor into the home of William and Kesheanna Todd and their four children on Nov. 16.
