LOUISVILLE, Ky. (WDRB) -- A judge has issued a ruling in the case of a Charlestown neighborhood suing the city, however, both side are claiming a win.
Pleasant Ridge residents have been fighting the city's efforts to demolish homes making way for new development. In court, lawyers for the neighborhood association claimed the city was imposing thousands of dollars in fines for minor violations as a way to force them to sell and move out.
In December, a district court judge issued a temporary injunction to stop the city from enforcing its property maintenance code. But Monday, the Indiana court of appeals reversed that order.
The city of Charlestown calls it a legal win, but lawyers for the Pleasant Ridge neighbors said the reversal is only because of a legal technicality, and they expect the injunction to be quickly be reinstated.
