LOUISVILLE, Ky. (WDRB) – The University of Louisville Foundation will not have to pay James Ramsey’s attorney fees and costs in the lawsuit the university and foundation filed in April against the former U of L president for alleged financial mismanagement and fraud.

Jefferson County Circuit Court Judge Judith McDonald-Burkman ruled in favor of the foundation in an order dated Nov. 15.

She denied Ramsey’s request to force the nonprofit organization to pay his attorneys and costs, such as for expert witnesses, as he incurs them. But McDonald-Burkman left open the possibility that the foundation could have to cover those costs at the conclusion of the case if Ramsey prevails.

“Under no circumstances should the University of Louisville Foundation be required to spend donor money on the legal fees for people whose mismanagement of the Foundation triggered the legal action in the first place,” the foundation’s outside lawyer, Andy Campbell, said in a prepared statement Tuesday. “Donors give contributions for academics, not to defend people in court who squandered millions and put the Foundation in a deep reputational and financial hole.”

Ramsey’s attorney did not immediately respond to a request for comment.
