LOUISVILLE, Ky. (WDRB) -- A mediator has been chosen for the case between New Albany and the Indiana Department of Natural Resources concerning the Silver Creek dam.

The controversy started after 14-year-old AJ Edwards drowned there on Memorial Day last year.

The issue involves "emergency maintenance" on the dam, ordered by Mayor Jeff Gahan.

Indiana's DNR and the U.S. Corps of Engineers ordered that work to stop, alleging Gahan did not have the proper permits to order the maintenance.

Now, Superior Court Judge Heather Welch will serve as a mediator to figure everything out. 

A permanent injunction against New Albany is on the table. A hearing date has not yet been set.
