LOUISVILLE, Ky. (WDRB) -- The owner of a local pool company under investigation by authorities in Kentucky and Indiana has been indicted in Bullitt County.

Tracy Davenport, owner of Davenport Extreme Pools and Spas, was indicted Wednesday on two counts of theft.

Davenport and her husband, Matt Davenport, are facing charges in southern Indiana, accused of taking people's money for pools but never building them.

The indictment in Bullitt County are the first charges against Davenport in Kentucky, although the state's attorney general has said the company was under investigation. 

People like Bullitt County resident Cory Dahlkamp have been waiting for Davenport to be charged in Kentucky. In our WDRB Investigates story in April, she said, "We did pay her the $46k and of course received nothing, our contract was filed in 2021, no accounting of where our money went, what it was spent on."

Dahlkamp told WDRB News on Thursday afternoon, "I could not be happier. I'm hoping other counties will follow suit."

"I'm very proud of Bullitt for looking out for its residents who have been scammed," she said. "I'm hoping she receives some consequences, some justice being served through her time or inconvenience."

Dahlkamp doesn't think she'll get any of her money back, but is hopeful.

She said she kept pushing for criminal charges in Bullitt County and was happy that an investigator started looking into the case and brought it to a grand jury. She said the Bullitt County charges are for her case and another in Mt. Washington.

Prosecutors in Indiana said the couple may have taken hundreds of thousands of dollars from several customers. The Davenports face criminal charges in Floyd and Clark Counties in southern Indiana.

According to court documents, the couple took more than $245,000 from four victims in Floyd County to build pools, dating back to 2021. But they never built anything.

Prior to that, they turned themselves into the Clark County Jail, charged with four counts of theft, four counts of fraud and two counts of corrupt business influence in Clark County — all felony charges.

Lawsuits have also been filed against the company. One lawsuit alleges Davenport spent customer money on "lavish vacations to Las Vegas, personal cosmetic surgeries, a six-figure recreational vehicle, and the purchase of an expensive pleasure cruising lake boat."

The couple filed for bankruptcy late last year. Tracy Davenport told WDRB News she isn't commenting and to reach out to her attorneys. They also aren't commenting.

She's expected to be arraigned on the Bullitt County charges on Nov. 16.
