The Kentucky Court of Appeals ruling, issued Monday morning, is the latest setback in Chief Robert Schroeder's efforts since early August to avoid answering questions from the Louisville Metro Council's government oversight and audit committee. 

The judge said she wouldn't hold Schroeder in contempt of court if he testifies to the committee next Monday.

In Tuesday's ruling, a judge said Chiefs Hess and Schroeder, as witnesses subpoenaed by Metro Council, "do not have a right to insist that their testimony occur privately, shielded from public view."
