LOUISVILLE, Ky. (WDRB) -- Steve Lawson is expected to be in court Thursday morning, but Brooks Houck and Joseph Lawson will not appear in court this week.

The men are all charged in the death of Crystal Rogers — the Bardstown mother who has been missing since 2015.

According to a new court filing, Steve Lawson is trying to get the case dismissed.

In July, the court is scheduled to hear why Brooks Houck wants to keep the trials separate from one another. After that, the court will decide whether to consolidate everything into one trial next year.

A motion filed earlier this month by Brian Butler, an attorney for Houck, argued against trying the Lawsons and Houck together instead of separately. In the motion, Butler argued Steve Lawson "fabricated the entire story" of what happened after Rogers disappeared in 2015 after being threatened, coerced and promised immunity by investigators.

Butler also argued that prosecutors want jurors to hear statements to the grand jury from Steve Lawson and the jail phone call without knowing that he was threatened, promised immunity and fed information by investigators.

If all three men are tried together, Butler argues, it is doubtful Steve Lawson will testify, meaning Houck's defense will be unable to question him about the multiple contradictions in his statements.

A judge has yet to decide if the trial will be moved to Hopkinsville. In April, the the special prosecutor in the case and attorneys for the three men agreed that the trial should be moved from Nelson County to Christian County. They argued there has been too much publicity surrounding Rogers' disappearance to find an unbiased jury in Nelson County.

Rogers was last seen with her boyfriend, Houck, during the Fourth of July weekend in 2015. Her car was left running on the side of Bluegrass Parkway with her purse still inside. She's presumed dead, but her body has never been found.
