LOUISVILLE, Ky. (WDRB) – A woman who claimed in a Facebook post that she was sexually assaulted by Haymarket Whiskey Bar owner Matthew Landan has filed a lawsuit against Landan, claiming he has been harassing her in an attempt to intimidate and silence her and other possible victims.
The lawsuit comes a year after Landan sued the woman and others who accused him of rape.
The woman, whom WDRB News is not naming because she is an alleged rape victim, posted a picture of Landon on Facebook on Nov. 13, 2017, saying, “Matthew Landan is a rapist.”
Since then, the woman claims, Landan and his attorney, Andrew Horne, have sent repeated subpoenas seeking information to her employer “for the sole purpose of harassment, intimidation, and to send a message to other victims who were or may speak out.”
Horne said in a phone interview Wednesday morning that he had not reviewed the lawsuit and declined to comment.
Landan has subpoenaed the woman to provide the date and time of each instance she had sex with Landan and identify anyone else present.
In addition, Landan’s attorney has also requested any available mental health treatment the woman sought after the incident and what actions she took in the 48 hours after the alleged rape.
The lawsuit claims Landan is selectively using the courts to try and punish the woman, while he hasn't taken similar legal action against the author of a letter to LEO Weekly in April that claimed he is a "serial rapist."
The suit, filed by attorneys J. Allan Cobb and Holland Houston, is seeking a jury trial and unspecified monetary damages.
Landan’s defamation lawsuit is pending, and his attorney claims defendants in the suit are not properly turning over evidence.
His lawsuit also names two former employees, Eric Snider and Christopher Maggio, as the two men who staged a walk out of employees shortly after the allegations surfaced.
Snider and Maggio have filed a counterclaim accusing Landan of trying to "silence any and all public discourse regarding the accusations against him for criminal sexual misconduct."
Landan, who was accused by multiple women of drugging and sexually assaulting them, has not been charged criminally.
The lawsuits will be back in court on Dec. 3.
