LOUISVILLE, Ky. (WDRB) -- A man charged in a fatal shooting in Prospect claims it was an accident and has entered a not guilty plea.
James Small, 20, was in court Wednesday morning. He is charged with manslaughter in the shooting death of 23-year-old Charl Hertzog late Monday night.
On Wednesday, Small's attorney claimed Small was drinking and smoking weed when the gun went off while he was cleaning it. Police said after the shooting, Small left and got rid of the gun.
Small then turned himself in. He is also charged with tampering with evidence.
The shooting happened at a home on Duroc Avenue off River Road, near U.S. 42.
