LA GRANGE, Ky. (WDRB) — The Louisville man responsible for a 2023 police chase that ended in the death of a 10-year-old Oldham County boy was sentenced Wednesday to 40 years in prison.
In Oldham County Circuit Court on Wednesday afternoon, 12th District Court Judge Jerry Crosby sentenced Tymetrius Walter for his role in the death of the boy.
"Let me be clear on this: You are solely responsible in this particular case for this tragic accident," Crosby said in court Wednesday.
Walter, 26, pleaded guilty last month to vehicular homicide while under the influence and several other charges stemming from the deadly crash that killed Jake Luxemburger. The plea agreement reduced his original murder charge. He also pleaded guilty to first-degree fleeing or evading police and other offenses.
"I am truly sorry for what I took Sept. 16," Walter said in court Wednesday. "That day also changed my life forever. I apologize for my own actions that lead to this. I never thought this would happen when I woke up that day."
The case stems from Sept. 16, 2023, when a Kentucky State Police trooper attempted to stop a vehicle traveling on Interstate 71 in Oldham County. Investigators said Walter sped away, reaching speeds of up to 115 mph after troopers discovered the vehicle had been reported stolen.
Authorities said Walter exited the interstate at Exit 14 and crashed into an SUV traveling north on Kentucky 329.
"You didn’t just take Jake’s life that day," said Kate Luxemburger, Jake's mother. "You destroyed an entire family. One second, we were a family of four. And then we were a family of three."
Jake, a fifth-grade student at Kenwood Station Elementary School, was riding in the SUV and died from his injuries. The SUV's driver was seriously injured.
"The consequences of that day do not end with a crash," said Riley Luxemburger, Jake's sister. "We continue to live with them every single day. Jake deserves to grow up. He deserves his future. And my family deserves to keep him."
