LOUISVILLE, Ky. (WDRB) -- A judge ordered prosecutors to clearly spell out the charges against Nelson County Sheriff Ramon Pineiroa and his chief deputy, Brandon Bryan, who were indicted earlier this year.
The case is part of a whistleblower lawsuit claiming the men punished a detective who reported a supervisor for breaking the law. The sheriff and chief deputy are accused of illegally selling three vehicles from a Nelson County evidence warehouse.
In a court document, Bryan's attorney argued the allegations in the indictments are too vague.
"He denies all wrongdoing and the vague nature and unspecified nature of the allegation has served to create unjust speculation about his conduct," Bryan's attorney wrote in the motion. "He is entitled to sufficient notice of the allegations so that he can fully defend himself."
So in her order last week, Special Judge Elise Spainhour gave prosecutors 20 days to provide a "Bill of Particulars" in the case, a legal document that provides more details about charges and claims brought against a defendant.
Prosecutors must now spell out the exact dates, times and locations of the alleged crimes as well as the specific conduct that led to the charges. The judge also recently agreed to seal certain investigative documents in the case at the request of prosecutors.
According to court records, when Drug Task Force Detective Ian Justice reported the sales, Pineiroa retaliated against him and Detective Will Purdom by pulling them off the task force and forbidding them from working any overtime. The detectives are now suing for damages, including lost wages.
Bryan and Pineiroa are scheduled to appear in court again next month. The case is scheduled to go to trial in October.
