John Miller was in court Feb. 3, where a judge denied a motion to dismiss the case.
The former sheriff was ordered to pay the restitution after he pleaded guilty to 27 felonies related to fraud and theft after he used taxpayer money to pay for a massive car collection, an airplane, designer clothes, guns and jewelry.
Noel pleaded guilty to theft, obstruction of justice, tax evasion, money laundering, corrupt business influence and official misconduct on Aug. 26.
