LOUISVILLE, Ky. (WDRB) — A former Clark County Council member will stand trial for charges stemming from the Jamey Noel investigation, a judge ruled Monday.
The conflict of interest charge against John Miller, also a Noel associate, will stand.
Special Judge Larry Medlock said a jury needs to decide whether Miller got any benefits for voting for county contracts with New Chapel EMS, which Noel owed.
Miller was in court Feb. 3, where Medlock denied his motion to dismiss the case.
As a council member, Miller approved funding for New Chapel. Prosecutors said he did that without disclosing his conflict of interest.
Miller, who was also a Clarksville Police officer, is also charged with official misconduct, accused of accepting gifts from Noel such as meals, concert tickets and vacations.
Last year, Noel was sentenced to 12 years in prison after pleading guilty on Aug. 26 to 27 felonies for theft, obstruction of justice, tax evasion, money laundering, corrupt business influence and official misconduct.
Noel's daughter, Kasey Noel, and estranged wife Misty Noel were also charged with theft and tax evasion. Kasey Noel was sentenced to nine months in the Harrison County, Indiana, jail.
Another former Clark County council member, Brittney Ferree, was also arrested and charged last year with official misconduct for accepting child support payments, trips and other expenses from Noel that he paid with money from Utica Township Volunteer Firefighters Association.
Miller's trial is scheduled for Oct. 27 in Clark County Circuit Court.
