The Harrison County prosecutor said lethal force was justified when a man was shot by sheriff's deputy on Nov. 4.
The man, 28-year-old Michael Kerns Jr., first approached officers outside with a chainsaw and refused to listen to orders of putting it down.
It happened Wednesday at about 9 a.m. in Jefferson County in Indiana.
The Watson Road Connector would join Highways 11 and 135 at Highway 337. Neighbors like Angela Schmelz say the new road would be "devastating."
