LOUISVILLE, Ky. (WDRB) -- Tracy Davenport was arrested again Monday, this time on out-of-state drug charges. New Jersey State Police said Davenport and a man were arrested after a truck inspection, during which investigators found a large amount of drugs.
Davenport, the owner of a Louisville-area pool company under investigation by authorities in Kentucky and Indiana, was arrested in Alpha Borough, New Jersey.
According to a news release from James Pfeiffer, the Warren County prosecutor, Davenport was a passenger in a truck driven by Corey B. Young, 38, of Brooks, Kentucky. When New Jersey State Police conducted a commercial vehicle inspection on Route 78, police said they found 179 pounds of marijuana worth an estimated $250,000. They also found a loaded handgun and a large capacity magazine.
Davenport, 49, faces a first-degree charge of possession with intent to distribute marijuana and a lesser fourth-degree possession charge. Investigators say the two were in a pick-up truck carrying a trailer.
Young faces eight charges, including first-degree possession with intent to distribute marijuana, second-degree unlawful possession of a handgun and other second- and fourth-degree weapon-related charges. The first-degree charges carry a maximum potential sentence of 20 years in New Jersey. Second-degree charges carry a maximum of 10 years.
Warren County's First Assistant Prosecutor, Anthony Robinson, said Young was detained and then released ahead of a court date next month. Davenport was released immediately after her arrest.
Davenport is the subject of multiple high-profile investigations in Kentucky and southern Indiana in connection with Davenport Extreme Pools and Spas, which she owns with her husband Matt Davenport. She also also been the focus of WDRB Investigates stories. She was indicted in October on two counts of theft in Bullitt County and was scheduled to be arraigned Thursday.
The Davenports are accused of taking people's money for pools but never building them.
The indictment in Bullitt County are the first charges against Davenport in Kentucky, although the Attorney General's Office has said the company was under investigation. Davenport was scheduled to be arraigned on her Bullitt County theft charges Thursday. Victims who attended say she wasn't there and the case was rescheduled for next month.
Prosecutors in Indiana said the couple may have taken hundreds of thousands of dollars from several customers. The Davenports face criminal charges in Floyd and Clark counties in southern Indiana.
According to court documents, the couple took more than $245,000 from four victims in Floyd County to build pools, dating back to 2021. But they never built anything. Prior to that, they turned themselves into the Clark County jail, charged with four counts of theft, four counts of fraud and two counts of corrupt business influence in Clark County — all felony charges.
Lawsuits have also been filed against the company. One lawsuit alleges Davenport spent customer money on "lavish vacations to Las Vegas, personal cosmetic surgeries, a six-figure recreational vehicle, and the purchase of an expensive pleasure cruising lake boat." One lawsuit alleges Davenport collected more than 5 million dollars from about 60 families for swimming pools that were never installed.
In court documents, Davenport's attorney points out there have been no convictions of any criminal charges. Her attorney said the couple withdrew 189-thousand dollars from their retirement accounts to loan to the pool company so it could stay in business. The couple filed for bankruptcy late last year.
