Damien Smith appears in Jefferson District Court on Wednesday, May 24, 2023, where a plea of not-guilty was entered on his behalf. Smith was a teacher and coach at Western High School. He was accused of assaulting a 16-year-old student.

Smith is listed online as a social studies teacher at Western High School. Police said he is also a wrestling coach.

The incident took place May 10, according to court documents, and the victim was a 15-year-old student he was coaching. Police said he grabbed the student and slammed him onto a table. He then placed him on the ground and got on top of him, according to police.

Aniston Curry said he is the student that Smith attacked. Curry says the assault occurred after a wrestling banquet. He says they got into a verbal altercation. Curry then went to the basement of the school to eat.

"I'm turned around he comes from behind me grabs me by the collar, pushing up against the table," said Curry. "He slams me on the table, starts yelling and cussing in my face."

The attack continued "He slams me on the ground puts my arm behind my back... blows my wrist... and then starts cussing in my face some more. I try to get back up and he slams me back on the ground," Curry said.

Curry said while this was happening he was calling for help and no one came. He says eventually another coach broke up the attack.

Curry has chosen not to go back to school since this happened.

"There's been a lot of free Mr. Smith posters around Western they've been taunting me I just don't want to go to that environment," said Curry.

Curry said before the incident Smith was one of his favorite teachers, Smith even used to drive Curry to practice.

When confronted, Smith allegedly admitted to the incident. He was arrested and charged with fourth-degree assault.

A not-guilty plea was entered on his behalf during his initial appearance Wednesday morning in Jefferson District Court. His bond was set at $5,000.
