LOUISVILLE, Ky. (WDRB) -- Testimony is expected to continue today in the murder trial of Jeffrey Mundt. Mundt, along with another man -- Joseph Banis --Â is accused of killing their sex partner and drug dealer, James Carroll and hiding the body in the basement of the home they shared in Old Louisville in 2009.
Banis was convicted of murder in this case in March, and was expected to be the star witness after he agreed to testify against Mundt in exchange for prosecutors dropping the death penalty. But he reneged on that deal earlier this week.
In court today, judge Mitch Perry questioned Banis about a jailhouse meeting he had with a detective and prosecutor in the case.
After hearing from Banis, Perry ruled that he will be allowed to testify against his former lover.
This comes after the defense and prosecution spent the morning arguing over that jailhouse meeting.
Defense attorneys wanted the case dismissed and accused the prosecution with prosecutorial misconduct.
