LOUISVILLE, Ky. (WDRB Fox 41)---In early November, Louisville police were called to the parking lot of the Walmart on Raggard Road, where an alleged shoplifter had been shot.

The incident involved a Jefferson County constable, and at the time, he told police he was inside the store shopping and was notified by employees.

He told them, he followed her outside to her truck.

"When he got to that vehicle, allegedly that vehicle ran over his foot. At that time, his service weapon was drawn and a shot was fired and struck that individual in the arm and hand," LMPD spokesman Dwight Mitchell said at the time.

Newly released video is now giving us a better look at what happened.

As Tammie Ortiz is leaving the Walmart, she is surrounded in the store by four men, believed to be loss prevention officers.

One takes one of her shopping bags. She then places another bag down, and leaves the store.

The four men continue to follow her outside the store, where you can see Ortiz rush to her red truck.

A white vehicle then pulls around the corner and parks behind the truck.

Off-duty constable David Whitlock is the driver, and exits the truck armed with a gun.

It's at this point, Whitlock tells authorities he shot Ortiz when he says she backed over his foot.

Ortiz claims, she thought she was being mugged. Her wounds were non-life-threatening.

She narrowly missed hitting a red car as she was backing up.

Surveillance video then shows her speeding through a stop sign, and leaving Walmart.

Whitlock has told authorities he was trying to defend himself after Ortiz ran over his foot.

A grand jury recently indicted him on assault and wanton endangerment charges.

On Monday, Whitlock will appear in court for the charges he's facing in this case.

Ortiz, who has a lengthy criminal history under the name Tammy Lee Jamian, was recently arrested after this incident for allegedly trying to shoplift at Kmart.
