LOUISVILLE, Ky. (WDRB) -- The defense attorneys for the Delphi, Indiana, murder suspect claims the Carroll County Sheriff's Office lied about transportation of an inmate, FOX59 reported this week.
Richard Allen, 51, was arrested in October 2022 and charged with two counts of murder in the 2017 slayings of 13-year-old Abigail Williams and 14-year-old Liberty German. The Delphi man has pleaded not guilty to the charges.
Judge Fran Gull was assigned by the Indiana Supreme Court to the case after the original judge recused himself. Allen's attorneys have since tried to have Gull removed from the proceedings by accusing her of bias. The Indiana Supreme Court declined to take Gull off the case.
In a new motion, defense attorneys claim the Carroll County Sheriff's Office lied about the circumstances surrounding the transportation of a Westville Correctional Facility inmate for a June 2023 hearing. The motion claims that Gull contradicted the sheriff's office report about the matter.
Allen's attorneys wanted an inmate to testify about "harsh, abusive and unconstitutional treatment" of Allen at Westville Correctional. The inmate was a key witness in the hearing, the defense claims.
But the inmate refused to leave his cell to testify. The sheriff's office reported said Sheriff Tobe Leazenby called Gull's office to inform them about the situation. The motion claims Gull's office advised to leave the inmate there if he did not want to attend the court hearing.
Gull wrote that the "decision by the Deputy to leave without the witness was his and was not directed by the Court" in a May 31, 2024, order. Allen's attorneys said the order was the first time they noticed a discrepancy.Â
