LOUISVILLE, Ky. (WDRB) -- A judge is giving the son of Louisville's mayor a chance to clear the misdemeanor drug charges against him.

George Fischer, 24, was not in court Tuesday, but his attorney appeared to discuss the drug charges against him.  

The citation says George Fischer was passed out at the wheel of an SUV parked in front of the Derby City Chop Shop on Bardstown Road just before noon on Dec. 9. 

Officers say they found marijuana and unmarked prescription drugs inside the vehicle. 

At the time, mayor Greg Fischer released a statement saying his son made a "bad decision" and that they were addressing it as a family.

The judge agreed to dismiss the case without prejudice; however, George Fischer must complete a marijuana education program.

If he fails to do so, the Commonwealth can move forward with prosecution.
