LOUISVILLE, Ky. (WDRB) -- A Kentucky couple is suing a baby formula company, claiming their baby was hospitalized after drinking it.
ByHeart's infant formula is at the center of a nationwide recall after it was linked to botulism.
The Richmond, Kentucky, family said their 4-month-old daughter was rushed to the hospital Nov. 8 and diagnosed with the serious illness.Â
The Kentucky Department of Health found the formula the baby consumed was from one of the recalled batches.
So far, only the Kentucky family and a family in Arizona have filed lawsuits against ByHeart. The lawsuits allege the ByHeart formula the babies consumed was defective and that the company was negligent in selling it. They're seeking payment for medical bills, emotional distress and other harm.
According to the Associated Press, both families said they bought the organic formula to provide what they viewed as a natural, healthier alternative to traditional baby formulas, and that they were shocked and angered by the suffering their children endured.
At least 15 babies across 12 states were hospitalized from the recalled formula. No deaths have been reported.
