NEW ALBANY, Ind. (WDRB) -- The mayor of New Albany missed the deadline twice now to restore the Silver Creek Dam.Â
The Army Corps of Engineers ordered the city of New Albany and the mayor to submit plans to restore the dam on Silver Creek within 30 days.
In August, Mayor Jeff Gahan ordered several tons of rocks dumped into Silver Creek next to the dam and called it "emergency maintenance."
The Corps of Engineers called it a violation of federal law. It came after 14-year-old AJ Edwards drowned in the creek on Memorial Day.
The city was given 30 days in August to submit plans to restore the area which weren't submitted then in September the Corps gave the city another 30 days and no plans were submitted.
WDRB was told the next steps to resolve the issue is including referring it to the U.S Attorney.
