LOUISVILLE, Ky. (WDRB) — An arrest warrant for former Kentucky Gov. Matt Bevin was recalled Friday after a Court of Appeals request Thursday.
A warrant was issued Tuesday for the former governor. Bevin claims he turned over some of the records, but the judge said the court is still waiting on supporting documents.
Kentucky Court of Appeals Judge Audra Eckerle ordered the warrant recalled. The order came after Eckerle found Family Court Judge Angela Johnson issued the warrant after Bevin requested her recusal.
A hearing scheduled for Friday morning was canceled Thursday as his attorney seeks to disqualify Johnson from the case. Attorneys are awaiting a decision from the chief justice of the Kentucky Supreme Court.
Johnson gave Bevin an ultimatum: go to jail for two months or submit the records needed for child support for his adopted son, Jonah Bevin, and pay a $500 fine.
Bevin appeared via video conference Tuesday morning in Jefferson Family Court.
Bevin attended the hearing via video conference because he was driving home from the funeral of his ex-wife’s father in Oklahoma.
According to court documents, Bevin filed a petition Thursday with the Kentucky Court of Appeals to prohibit enforcement of his arrest and stop Johnson from taking further action in the case.
The petition states enforcement of the arrest "would cause an irreparable injury to Matt, which would be so ruinous in nature that it cannot be allowed to proceed."
Court documents show the warrant was verbally recalled by Johnson, and an order will follow.
In a statement, Bevin's attorney said:
"We are grateful for the swift action taken by the Kentucky Court of Appeals to uphold longstanding Kentucky law and correct Judge Angela Johnson’s blatant disregard for that law. This ruling makes clear that no judge is above the law. We look forward to decisions from the Kentucky Supreme Court regarding Mr. Bevin’s pending motion to disqualify Judge Angela Johnson and from the Kentucky Court of Appeals regarding Mr. Bevin’s two (2) pending Petitions for Writ of Mandamus or Prohibition."
