LOUSIVILLE, Ky. (WDRB) -- Kentucky Horse Racing & Gaming and several charities have dropped their lawsuit over electronic pulltab machines.

The case challenged a November 2025 order that temporarily disabled the devices following reports of theft.

The order came after multiple reports of illegal “fishing” activity that resulted in the theft of tens of thousands of dollars. Following the order, the manufacturers of the machines made updates to prevent tampering.

Since then, the Kentucky Horse Racing & Gaming Commission (KHRGC) has received no further reports of illegal activity, ensuring the integrity of the devices for charitable gaming purposes.

Officials said the dismissal isn’t an admission of fault and avoids costly, prolonged litigation.

The organizations involved in the lawsuit included Shirley’s Way, Inc., the Southwest Center for the Developmentally Disabled, Inc., and Educational Justice, Inc., all of which operate charitable gaming programs supported by pulltab revenue.

The KHRGC said it will continue to monitor gaming operations closely, ensuring compliance while supporting the charities that rely on pulltab proceeds for their programs.
