LOUISVILLE, Ky. (WDRB) – The owner of Nowhere Bar on Bardstown Road in Louisville has been cleared of sodomy and sexual abuse charges.

A Jefferson County grand jury on Sept. 20 issued a "no true bill" on the charges against David Mattingly, meaning they did not find enough evidence for the case to continue.

Last September, Mattingly was accused of making a drink for a person at his home and touching them inappropriately after the alleged victim lost consciousness.

Frank Mascagni, Mattingly's attorney, said they had to wait for a year to get lab reports back, and Mattingly's business has suffered in the meantime.

"We're glad to put it behind us," Mascagni said. "He maintained his innocence throughout and looks forward to getting back to work rebuilding his business and family."

The alleged victim still has a pending lawsuit against Mattingly.
