Kasey Noel was arrested March 8 on nine felony charges, including five counts of theft and four counts of tax evasion.
The lawsuit claims Noel has not given back the credit cards even though he was removed as chief earlier this year, and may still be charging items on them.
Misty and Kasey Noel have asked Judge Larry Medlock to allow them to stand trial together, since both are facing similar charges in the investigation into Jamey Noel.
