JEFFERSONVILLE, Ind. (WDRB) -- The trial for former Clark County Sheriff Jamey Noel's estranged wife and daughter is still in limbo.

A jury trial for the Jamey Noel's daughter, Kasey, was scheduled to start Aug. 20, but it has been delayed until Judge Larry Medlock issues a ruling on a request earlier this month asking that their trials be joined. 

Kasey and Noel's estranged wife, Misty, petitioned the court on Aug. 6 to have their cases combined, since they both face similar charges connected to the investigation into Jamey Noel. 

The ex-sheriff remains in custody at the Scott County Detention Center on a $1.5 million bond. He is facing 31 charges related to allegations he used millions of dollars from two agencies he used to run — New Chapel Fire/EMS and the Utica Township Volunteer Fire Department — for his own benefit. Charges include fraud, money laundering, misconduct, ghost employment and public corruption. 

Misty and Kasey Noel are both facing multiple felony charges for theft and tax evasion. They have pleaded not guilty and are free after posting bond. 

Misty Noel was charged with 10 felonies in the case. She was arrested in February and spent a weekend in the Scott County Detention Center before her first court appearance, and was released from jail after posting a $30,000 cash bond. 

Kasey Noel was arrested in April on nine felony charges, including five counts of theft and four counts of tax evasion. Search warrants in the corruption case of Jamey Noel indicate Kasey charged more than $100,000 to the Utica Volunteer Fire Department and New Chapel EMS. 

According to court documents listing items purchased, Kasey Noel made purchases for: clothing, tanning, cosmetics, manicure and pedicure services, food, tickets, trips, alcohol, utilities, vaping products, gas, Netflix and items from Amazon. The charges occurred between October 2018 and September 2023, totaling $108,660.59. 

Ric Hertel -- the special prosecutor assigned to the case -- told WDRB all parties have submitted pleadings to the judge's office. A status hearing is planned later this week to get a ruling or direction from the judge, but there's no word yet on what the final result of that status hearing could be. 

One important issue Judge Medlock must consider is the fact that, even though Kasey and Misty's charges are similar in number and nature, having them stand trial together would be an exception to Indiana state law. Hertel said not having separate trials could also complicate the jury selection process. 

"Kasey -- who is charged with an F6 (level 6 felony) -- is entitled to a six-person jury and Misty -- who is charged with an F5 (level 5 felony) -- is entitled to a 12-person (jury), so the law requires different numbers in the jury pool," Hertel said. "So that is kind of the dilemma the judge has to wrangle with now," Hertel said.

To get around that, Misty Noel's attorney, Bart McMahon, said "Misty would have to waive her right to a 12-person jury, if Indiana law allows it." 

Judge Medlock is also expected to rule on Misty and Kasey's request for permission to travel to Louisville while awaiting trial. Right now the conditions of their bond prohibit them from leaving the state. 

Misty and Kasey's next court dates are up in the air until Medlock releases his decision.  

Misty Noel filed for divorce from Jamey Noel earlier this month, claiming the marriage is "irretrievably broken." The filing said the couple has been separated since April.

Jamey Noel served as Clark County sheriff from 2015-23 and also led New Chapel Fire/EMS and the Utica Township Volunteer Fire Department. His jury trial is scheduled to begin in November.
