LOUISVILLE, Ky. (WDRB) -- The mother of Brooks Houck has withdrawn her custody request for the child her son and Crystal Rogers shared.

Houck is in jail, charged with killing his son's mother, Rogers.

The child was two years old at the time his mother went missing in 2015. He is now 10 years old, almost 11. 

Last month, both of his grandmothers, Rosemary Houck and Sherry Ballard, Rogers' mother, fought for custody of him in court.

But Rosemary Houck has since withdrawn her custody request. She was also named in court last week by the special prosecutor in the Rogers murder case for secretly recording grand jury testimony.

Brooks Houck was arraigned in Bardstown on Oct. 5 in the first hearing since he was arrested last month and charged with the death of Rogers, who went missing in 2015. 

Earlier this month, Houck's attorneys asked a judge to lower his $10 million bond to $500,000 with GPS monitoring. But on Monday, a Nelson County judge ruled that the bond will remain while he awaits trial for the murder of Rogers. 

Tuesday, attorneys for Houck asked the Kentucky Court of Appeals to review the ruling.
