LOUISVILLE, Ky. (WDRB) -- A state representative from Shively and the city's former mayor has been arrested.

The 62-year-old was charged with DWI-second offense and reckless driving. Both are misdemeanors.

In a release, Shively Police Sgt. Jordan Brown said Beverly Chester-Burton was stopped on Garrs Lane around 1 a.m. Tuesday.

According to the arrest citation, Chester-Burton drove her vehicle into oncoming lanes before pulling back into the correct lane and parking, as Shively Police were responding to a domestic run. 

Police said they smelled a "strong odor" of alcohol, when she got out of her vehicle. The report said her speech was slurred, when she told officers she was coming from Frankfort and that "people were calling asking her and asking what was going on." 

The citation said she tried to get back into her vehicle several times and was stopped by officers. She also told them she wanted to call the chief before she almost fell trying to get into the backseat of her car, according to the report. 

Police said Chester-Burton refused a field sobriety test and a breathalyzer multiple times telling them "she would beat it like she did the last one." 

After being placed under arrest, Chester Burton told the officer transporting her to jail that "these guys act like they haven't ever been to a birthday party." 

The Democrat is currently serving her first term in Frankfort representing the 44th District, which includes parts of southwest Jefferson County.

Chester-Burton was also arrested for DWI in 2020 while she served as mayor. She pleaded guilty to that offense and paid a $694 fine.
