LOUISVILLE, Ky. (WDRB) — A Louisville man will be sentenced Wednesday on his conviction in a police chase with a stolen vehicle that ended in a crash, killing a 10-year-old boy in Oldham County.
Tymetrius Walter, 26, pleaded guilty earlier this month to vehicular homicide while under the influence as part of a plea agreement accepted June 9 in the death of Jake Luxemberger.
Court records show the agreement was filed following mediation earlier that week. As part of the deal, Walter's original murder charge was amended to vehicular homicide while under the influence. He also pleaded guilty to several other charges, including first-degree fleeing or evading police.
Jake Luxemburger, a 5th grade student at Kenwood Station Elementary School, was killed on Saturday, Sept. 16, 2023 after police said 23-year-old Tymetrius Walter crashed into the SUV Luxemburger was riding in. In September 2023, a Kentucky State Police trooper tried to pull over a vehicle on Interstate 71 in Oldham County around 3:30 p.m., officials said. The vehicle did not stop and sped off, reaching speeds up to 115 mph.
During the pursuit, troopers learned the vehicle had been reported stolen. Police said the vehicle exited I-71 at Exit 14 and crashed into a GMC SUV traveling north on Kentucky Route 329.
Walter was taken into custody after the crash.
Officials said Luxemberger, who was riding in the SUV, died from injuries suffered in the crash. The SUV's driver was taken to the hospital with serious injuries.
A judge is expected to sentence Walter to up to 40 years in prison.
