LOUISVILLE, Ky. (WDRB) -- A Louisville-area pool company owner pleaded guilty to theft in southern Indiana and was ordered to pay back the victims.
Tracy Davenport was in Clark County court Monday morning and took a plea deal. She had originally pleaded not guilty but changed her plea to guilty to theft and corrupt business influence. Her fraud charge was dismissed. Prosecutors said the plea agreement calls for Davenport to pay restitution to four Clark County families.
Davenport is accused of taking money from dozens of clients to build pools in several Kentucky and Indiana counties but never completed the work.
According to the plea agreement, prosecutors said Davenport will also serve a seven-year sentence with four years in prison, two on home incarceration and one year on probation. A judge still has to finalize that.
The judge ruled that bond money paid on her behalf can immediately be released to the victims, which equals around $12,500. The total amount she has to pay back to Clark County families is $245,000, and that's expected to be paid after serving prison time.
She also pleaded guilty in Floyd County to felony theft and fraud charges. Davenport and her husband, Matt Davenport, own Davenport Extreme Pools and Spas. Matt Davenport has not been charged.
Tracy Davenport also pleaded guilty in Bullitt County for two other cases and avoided a trial. Her next court hearing there is in January. She was sentenced to five years supervised probation.
Davenport is scheduled in Clark County to be sentenced on Dec. 30. Prosecutor said there will be time for victims to testify.
